Donald Trump’s claim that he has absolute immunity for criminal acts taken in office as president is an insult to reason, an assault on common sense and a perversion of the fundamental maxim of American democracy: that no man is above the law. More astonishing than the former president’s claim to immunity, however, is the fact that the Supreme Court took the case in the first place. It is a process so vital, and so precious, that its first occurrence — with the defeat of John Adams and the Federalists at the hands of Thomas Jefferson’s Republicans in the 1800 presidential election — marks a second sort of American Revolution. And if the trial occurs after an election in which Trump wins a second term and he is convicted, then the court will have teed the nation up for an acute constitutional crisis. A president, for the first time in the nation’s history, might try to pardon himself for his own criminal behavior.

Trump has refused to accept his loss in the 2020 election, painted as martyrs the supporters who stormed the Capitol on Jan. 6, 2021, laid groundwork to deny the 2024 election results if he loses, and said he would be a dictator on his first day back in office if he wins. But according to the independent presidential candidate Robert F. Kennedy Jr., it is President Biden who poses the greater threat to American democracy — a view that Mr. Kennedy shares with Mr. Trump himself, and that democracy experts called “absurd” and “preposterous.”Such a perspective is possible because Mr. Kennedy, who has founded his political career on promoting vaccine misinformation and conspiracy theories about the government, sees the Biden administration’s efforts to curtail the spread of misinformation as a seminal issue of our time. Censorship, as he calls it, overpowers all other concerns about the political system. Mr. Kennedy’s stance drew fresh scrutiny this week after he said in an interview on CNN, “President Biden is a much worse threat to democracy, and the reason for that is President Biden is the first candidate in history, the first president in history that has used the federal agencies to censor political speech, to censor his opponent.” He repeated himself on Fox News on Tuesday, saying that a president like Mr. Biden was “a genuine threat to our democracy.”

New York CNN —Cesar Conde has a decision to make — and it’s not an especially difficult one. The NBCUniversal News Group chair is facing a torrent of backlash from his own staff after greenlighting the hire of former Republican National Committee chair Ronna McDaniel as a paid network contributor. It does not take a brilliant political mind with prescient foresight to understand that hiring McDaniel would ignite a firestorm of outrage — from both within 30 Rock and outside it. After all, which NBC or MSNBC program is going to invite her on after all of this? If you believe President Biden’s aides and allies, he intends to fight the 2024 election primarily on the threat that Donald Trump poses to American democracy. By the time November rolls around, Biden’s longtime adviser Mike Donilon told The New Yorker’s Evan Osnos recently, “the focus will become overwhelming on democracy. Biden’s argument about democratic norms did seem to pay off in some key races in 2022, but I’m less convinced that it made the difference in 2020, at least relative to Biden’s promise to be a steady hand and his reputation for ideological moderation. To the extent that the White House knows this, we should probably take quotes like Donilon’s with a grain of salt. Maybe he was just dispatched to manage Biden’s liberal base, to preach the gospel of anti-Trumpism to a liberal publication’s readers while someone else gets to work on the more traditional economic appeals to swing voters.
